The Settlement

The $5.54 billion settlement is part of a long-standing class-action lawsuit against Visa and Mastercard. The lawsuit accused the credit card giants of imposing unfair fees on merchants, specifically swipe fees, which merchants have argued were excessively high and not transparent. 

The litigation began in 2005, initiated by merchants who claimed that Visa and Mastercard, along with several banks, colluded to set fees and rules for credit card transactions that were anti-competitive and violated antitrust laws. After years of legal battles and a previous settlement that was overturned on appeal, this $5.54 billion settlement is seen as a significant resolution.

On August 8, 2024, the Court granted a requested 180-day extension of the claims-filing deadline and extended the deadline to Tuesday, February 4, 2025.

FILING YOUR CLAIM AND HOW WE REPRESENT YOU.

OUR ROLE IN SUBMITTING YOUR CLAIM.

Accurate and Timely Submission: Once your eligibility is confirmed, our team takes charge of the entire process. From gathering required documentation to preparing and submitting your claim, we ensure everything is handled with precision. All claims must be submitted to Epiq Class Action & Claims Solutions, Inc. by February 4, 2025.

HOW YOUR SETTLEMENT AMOUNT IS DETERMINED.

The settlement you receive depends on the interchange fees your business paid for Visa and Mastercard transactions between January 1, 2004, and January 25, 2019. The Class Administrator will estimate these fees based on available transaction data. If data is incomplete or unavailable, you may need to provide supplemental information such as transaction volumes or total sales.​ If you disagree with the estimated claim amount, you’ll have the chance to challenge it by submitting supporting documentation.

MONITORING
AND UPDATES.

Claim Status Updates:

After submitting your claim, we’ll monitor its progress and keep you informed. Whether your claim is approved, partially approved, or flagged for deficiencies, we’ll handle the follow-up.

Resolving Deficiencies:
If there are errors or conflicts with your claim, we’ll communicate directly with the settlement administrator to address the issue. We’ll provide any additional documentation necessary to ensure your claim is processed fairly and accurately.

When to Expect Payment:

Payments will not begin until after the claims period closes on February 4, 2025. The pro-rata distribution can only be calculated once all claims are reviewed and approved by the Court. While this process may take time, we’ll keep you updated with any developments.

No Upfront Fees – Contingency Basis:

Our services are completely contingency-based, meaning there are no upfront fees. We only charge a percentage of the settlement amount awarded to you.

HOW TO SUBMIT YOUR CLAIM FOR THE SETTLEMENT.                    

To start the process for claiming your portion of the Visa Mastercard settlement, please complete the intake form. Ensure that the legal name of your business entity is accurately entered, as this information will appear on all documents.​

Disclaimer: Please note that your taxpayer identification number (TIN) will not be requested on the initial intake form. It will be required later in the Authority to Represent document. Additionally, ensure that the person signing the documents has the appropriate signing authority for the business. Junior titles may cause delays and necessitate re-signing of documents.​

 

STEP 1: Complete the Intake Form: Make sure to enter the legal name of your business entity and check the spelling carefully, as this information will appear on all documents.

  • Multiple Legal Entities: If you have multiple legal entities, each entity must be treated as a separate case. Please submit a separate intake form for each legal entity. If you are submitting MORE THAN 3 separate legal entities, please email Justin at justin@viceversavictory.com for additional assistance filing.

 

 

STEP 2: Receive and Sign Documents:

  • Within 24hours of submitting the form, you will receive two documents from Sharefile and/or Docusign.

  • An Engagement Letter

  • An Authority to Represent (9 Digit TIN will be collected here)

  • Review, sign, and return these documents promptly.

  • Both documents will be required per Legal Entity. For example, if you submit 3 legal entities you will receive 6 docs in total.

STEP 3: Case Submission and Review:

  • Once we receive your signed documents, Vice Versa Victory LLC. operations team will submit your claim to the settlement administrator.

  • You can expect a status update within 4 to 6 weeks. Potential statuses include: Approved, Conflict, Deficient, or Rejected.

  • You will also receive an estimate of your settlement claim, which is called the interchange fee impairment, along with the volume of transactions used from your merchant processing records to determine that amount; pending the status of your claim.

STEP 4: Follow-Up:

  • Our team or legal counsel may contact you if additional information or document re-signing is needed.
